Terms of Service
This English version is provided for convenience. The legally binding text is the Russian version, governed by the laws of the Republic of Kazakhstan.
This document constitutes a public offer (Article 395 of the Civil Code of the Republic of Kazakhstan) made by BASIS AI SYSTEMS (BIN 950802301411). Registration at cheapai.io constitutes full and unconditional acceptance of this offer. If you do not agree with any of its provisions, do not use the Service.
1.Definitions
- Operator — the entity identified in the preamble and in the “Operator details” section;
- Service — the software and hardware complex available at cheapai.io, including the web interface, API and user dashboard;
- Gateway — the Service’s programmatic interface that proxies User requests to Models;
- Model — an AI/neural-network model provided by a third-party supplier (Anthropic, OpenAI, Google and others);
- Model Provider — a third party that owns or holds the rights to a Model;
- User — a person who has registered for the Service and accepted this offer;
- Account — the User’s record in the Service;
- Balance — accounting units credited to the User’s Account upon top-up and consumed when calling Models;
- Tariff — the cost of using a specific Model through the Gateway, determined by the Model Provider’s rate plus the Operator’s minimal markup. Current tariffs are published at
/models; - Request — a User’s call to a Model via the Gateway;
- API Key — a secret token issued to the User for programmatic access to the Gateway.
- Subscription — a paid option granting an extended Quota of Model requests for a fixed period against a single upfront payment, purchased by the User in the manner set out in the “Subscription plans” section of this offer;
- Subscription Quota — the cap on accounting units available to the User under the purchased Subscription. Each Request reduces the Quota balance; upon its exhaustion before the end of the Subscription Term, further charges are switched to the User’s main Balance under the general Model Tariffs;
- Subscription Renewal — the operation by which the User voluntarily purchases additional Quota and additional term to an already active Subscription. The remaining Quota and unexpired term are preserved and added on top of the newly acquired amounts;
- Subscription Term — the period during which the User is entitled to use the Subscription Quota. Upon expiration, the Subscription terminates automatically and any unused Quota is annulled without monetary compensation.
2.Subject matter
The Operator provides the User with the technical ability to send Requests to third-party Models through a single OpenAI-compatible API and the Service’s web interface on a prepayment basis. The cost of each Request is automatically deducted from the User’s Balance at the moment of execution, at the Tariff then in effect.
The Operator is not the developer, owner or rightsholder of the Models. The Operator provides solely intermediary technical services: accepting a Request, forwarding it to the relevant Model Provider, and delivering the response to the User.
3.Registration and account
- registration is available to persons aged 18 (eighteen) or older with the legal capacity required to enter into this agreement;
- the User undertakes to provide accurate information upon registration and to keep it up to date;
- the User is solely responsible for safeguarding their password and API Keys; all actions performed under their credentials are deemed performed by the User personally;
- the User is responsible for compliance with the laws applicable to them, including restrictions on the use of AI services in the country where they are located.
4.Balance and payment
- the Service operates on a prepayment basis: the User tops up the Balance using any of the available payment methods published in the dashboard (bank card, SBP, USDT and others);
- upon registration, the Operator may grant the User a one-time promotional Balance to evaluate the Service; the amount and terms of such grant are determined by the Operator;
- the minimum top-up amount is 200 (two hundred) Russian rubles for payments via ruble methods (SBP, Russian bank cards, SberPay) or 10 (ten) US dollars (or the equivalent in another currency at the payment provider's rate) for payments via international cards, USDT TRC20 or Bitcoin. The specific thresholds and minimums for each method are shown on the top-up page
/topupand may be changed by the Operator without prior notice; - the cost of each Request is calculated based on the Tariff for the selected Model in effect at the time of the Request and is automatically deducted from the Balance upon execution. The minimum billing unit is published in the Model catalogue at
/models; - the topped-up Balance has no expiration date for as long as the Account remains active;
- Tariffs for Models are not fixed and may change at any time due to: (a) changes in pricing and access terms of Model Providers; (b) currency exchange rate fluctuations (some Tariffs are denominated in foreign currencies); (c) market conditions; (d) the Operator's decision regarding its markup and rate cards. The current Tariffs are always published in the Model catalogue at
/models; new Tariffs apply to Requests sent after the changes are published; - in the event of a material increase in the Operator’s markup (more than 30% over the current value), the Operator will notify Users with a non-zero Balance by email at least 7 (seven) calendar days before the change takes effect.
5.Subscription plans
Alongside per-Request charges from the Balance (“pay-as-you-go”), the Operator may offer the User the possibility of purchasing a Subscription — a single upfront payment for a predefined amount of Quota and a fixed Term of Service usage.
- Activation. The Subscription price is charged to the User’s Balance at once. Upon activation, the User gains access to the Subscription Quota in the amount specified in the chosen Subscription plan on the dashboard page
/subscribe; - Scope. The Subscription covers all Models available in the Service catalog at the time of the Request. Quota consumption is determined by the current coefficient of the Model in use, regardless of which specific Model is queried. The Operator may change the catalog of Models and their coefficients without prior notice to the User;
- Term — 30 (thirty) calendar days from activation, unless otherwise stated in a specific Subscription plan description. On expiration the Subscription terminates automatically;
- Renewal. The User may at any time before the Term expires purchase additional Quota and additional Term by Renewing the Subscription. Any remaining unused Quota and unexpired Term are preserved and added on top of the newly acquired amounts. Renewal is executed by charging the price to the User’s Balance in the same manner as the initial activation;
- Exhaustion of Quota within Term. If the User consumes all Subscription Quota before the Term expires, subsequent Requests are automatically paid from the User’s main Balance under the general Model Tariffs — without additional confirmation. The User is informed of this beforehand at Subscription activation;
- Expiration. Upon expiration of the Subscription Term any unused Quota is annulled without monetary compensation and cannot be transferred to a new Subscription or to the main Balance. Further use of the Service is possible on general terms (charges from Balance) or by purchasing a new Subscription;
- No refund. The price of a purchased Subscription is not refundable — neither on early cancellation initiated by the User, nor upon partial usage of the Quota, nor upon Term expiration. Services under a Subscription are deemed rendered properly at the moment of activation (Articles 393, 395 of the Civil Code of the Republic of Kazakhstan);
- Upgrade (moving to a higher plan). At any time before the Term expires the User may move to a plan priced no lower than the current one by paying its full price from the Balance. The new plan’s Quota and Term are added to the remaining unused Quota and unexpired Term of the current Subscription; the price difference between plans is not refunded or recalculated. Moving to a plan priced below the current one before the Term expires is not possible — it is available only after the current Subscription expires;
- Changes to Subscription terms. The Operator may change the price, composition and volume of Subscription plans at any time without prior notice. Such changes apply only to Subscriptions purchased after publication of the new terms; the terms of previously activated Subscriptions remain unchanged until their Term expires.
6.Referral program
- the Operator may, at its sole discretion, offer Users the opportunity to participate in a referral program — receiving bonuses for inviting new Users to the Service. The existence of the program, bonus amounts, thresholds, levels, accrual duration and other participation terms are published in the User dashboard at
/referral; - as of the date these Terms are published, a 4-tier scale is in effect: Bronze (5% of every top-up of an invited User at a lifetime invited-User top-up volume from $0), Silver (10% from $1,000), Gold (15% from $5,000), Platinum (20% from $25,000). The current tier and the rate applied to each accrual are displayed in the dashboard. The scale may be revised by the Operator at any time. For specific categories of Users the Operator may set individual rates and payout terms;
- the terms of the program may be changed by the Operator unilaterally at any time without prior notice. The rate in effect at the moment of a particular referee top-up is fixed for that specific bonus accrual and is not recalculated if tiers or rates change later;
- referral bonuses are credited to the User's internal referral account and may be transferred to the main Balance to pay for Requests. A referral bonus is not income, remuneration, compensation, fee or payment for any service; the User may not demand withdrawal of these funds to a bank account, bank card, crypto wallet or any other financial instrument. Transfer of bonuses is possible only within the Service and they are consumed on the same terms as the regular Balance;
- the referral program does not constitute a public offerwith respect to bonus size, duration of the program or the User's right to any particular level. The existence of the program, the rate and the tier thresholds may be terminated or modified at any time. The User may not demand from the Operator payment of bonuses that the User was expecting but which were not actually credited;
- the Operator may, at its sole discretion and without prior notice, suspend or terminate the referral program in whole or in respect of a specific User; set for a specific User an individual bonus rate within the range of 0% to 100% overriding the automatic tier calculation;
- Bad-faith conduct (abuse). The Operator may, at its sole discretion, cancel previously accrued bonuses, reverse or recalculate them (including retroactively), and block Accounts involved in bad-faith conduct. Bad-faith conduct includes, but is not limited to:
- creation by one person of multiple Accounts for the purpose of earning a referral bonus from top-ups on one of their own Accounts; use of third parties or fictitious individuals to register "invited" Users;
- use of the same device, IP address, device fingerprint or payment instrument across multiple Accounts; systematic use of VPN, proxy, anti-detect browsers or other means of identification evasion intended to disguise the referral relationship;
- sham top-ups — including those made with stolen, substituted, blocked or revoked payment credentials; chargebacks on top-ups for which a referral bonus has already been credited to the referring User;
- cyclical schemes such as "top-up → bonus accrual → chargeback / refund", "top-up → bonus transfer → new top-up using the transferred funds to trigger another accrual";
- paying or otherwise incentivising third parties (including through click farms, bot networks, multi-account hire services) to register under the referral link and artificially create the appearance of referral activity;
- collusion of a group of Users to jointly inflate the tier level of one participant; circular referral chains (User A invites User B, User B invites User A via a third Account, etc.);
- distribution of the referral link in conditions expressly prohibited by law, by the rules of advertising platforms or by the rules of third-party services (private-message spam, substitution of partner attribution markers, cashback schemes without the invitee's consent, placement in contexts incompatible with the subject matter of the Service);
- providing the invited User with false or misleading information about the Service in order to induce a top-up of the Balance;
- other actions aimed at obtaining a referral bonus in the absence of bona fide referral activity (i.e. actual attraction of a new independent User), which the Operator in its sole discretion qualifies as abuse.
- upon detection of abuse, the Operator may: (a) cancel all accrued bonuses on the relevant Accounts; (b) bring the referral account to a negative value and recover the amount of cancelled bonuses from the User's main Balance; (c) limit or terminate the User's access to the Service in the manner provided by these Terms; (d) transfer information about abuse attempts to third parties where this is necessary to protect the Operator's rights or to comply with applicable law;
- the Operator is not liable for errors in the calculation of referral bonuses and may correct such errors retroactively — both downward and upward. The calculation may be challenged by a written request to support; the Operator reviews such requests within a reasonable period, but the Operator's decision following such review is final.
7.Refunds
- the topped-up Balance is a prepayment and is consumed automatically as Requests are made; any unused amount remains on the Account until it is consumed or until the contract is terminated;
- amounts already used to pay for services rendered (executed Requests) are non-refundable — services are deemed duly rendered at the moment the Model’s response is received (Article 393 of the Civil Code of the Republic of Kazakhstan);
- the price of a purchased Subscription is non-refundable — neither on early cancellation, nor upon partial usage of the Quota, nor upon Term expiration. See “Subscription plans” for details;
- upon the User’s written request sent to the Operator’s email address, the unused portion of the Balance may be refunded to the payment instrument from which the top-up was made, within 10 (ten) business days. The Operator may withhold the costs actually incurred to process the refund (payment-provider fees);
- in the case of a confirmed fraudulent transaction (a payment made without the consent of the payment-instrument holder), funds are refunded after an internal investigation; to initiate the request, the User contacts the Operator’s email with supporting documents;
- if the Service is discontinued at the Operator’s initiative (except where the User has breached this offer), the unused Balance is refunded to the User within 30 (thirty) calendar days from the date of the discontinuation notice;
- no refund is issued if the Account is blocked by the Operator for a breach of this offer.
8.Prohibited use
The User is prohibited from using the Service to:
- violate the laws of the Republic of Kazakhstan, the country where the User is located, or applicable international law;
- create, distribute or store child sexual abuse material, calls for terrorism or extremism, or material inciting ethnic, racial or religious hatred;
- create, distribute or modify malicious software;
- infringe the intellectual or other rights of third parties;
- process personal data of third parties without a proper legal basis;
- create falsified images, audio or video of real persons without their consent (deepfakes), particularly for defamation, fraud or other harm;
- engage in mass automated requests to the Service aimed at disrupting its operation (DDoS, brute force, etc.);
- attempt unauthorized access to the Service infrastructure, or circumvent restrictions and limits;
- reverse-engineer the Service or its components;
- send spam, phishing or fraudulent messages;
- transfer the Account or API Keys to third parties (except where the Service is used on behalf of and in the interests of a legal entity to which the User belongs);
- violate the Acceptable Use Policies or Usage Policies of the Model Providers.
Violation of these prohibitions is grounds for immediate Account blocking without refund of any funds. In cases provided for by law, the Operator transmits information to authorized state bodies.
9.User representations and warranties
By accepting this offer, the User represents that they:
- have reached the age of 18 (eighteen) and possess the legal capacity necessary to enter into this agreement;
- hold all rights necessary to submit to the Service the content they transmit (text, files, images) and for that content to be further processed by the Models;
- have reviewed the Service’s Privacy Policy and consent to the processing of their personal data in accordance with it;
- understand that the Service provides intermediary access to third-party Models and accept the associated risks;
- use the Service at their own risk and bear sole responsibility for the application of the results obtained from the Models.
10.Beta status and test operation
As of the effective date of these Terms, the Service is in open-beta testing. Using the Service during this period implies elevated technical and operational risk, of which the Operator notifies the User in advance.
During the beta period, the following are possible:
- outages, brief or extended unavailability of the Service in whole or in part; scheduled and unscheduled maintenance;
- instability, request processing errors, increased latency, duplicate charges arising from client retry logic;
- errors in request cost calculation, Balance display, and statistics aggregation — both over- and under-charging; such errors are corrected by the Operator upon discovery, and the displayed amounts are recomputed;
- changes to the list of available Models, their parameters (including context window and supported features) and prices — possibly within a single calendar day, without prior notice;
- changes to Balance crediting rules, referral bonuses, rate cards and group discounts;
- temporary unavailability of specific features (key issuance, top-ups, statistics export and similar) for maintenance.
By using the Service during the beta period, the User confirms that:
- they are aware of the Service's beta status;
- they accept the risks listed above and waive any claim against the Operator for compensation of losses, including lost profits, damage to business reputation, or downtime arising from these risks;
- they use the Service entirely at their own risk;
- they understand that the Service in its current form is not intended for mission-critical applications — production-critical infrastructure, medical, financial, or legal systems with third-party obligations.
The Operator's guarantees regarding the safekeeping of funds on the Balance, refunds of unused funds (the “Refunds” section) and protection of Personal Data remain in full force during the beta period.
The Operator will announce the end of beta status by publishing a notice on the Service's homepage and/or by email to registered Users no later than 7 (seven) calendar days before the end-of-beta date. From that date onward, the provisions of this Section cease to apply.
11.Limitation of liability
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
The Operator makes no express or implied warranties regarding the Service, including but not limited to:
- the accuracy, completeness, correctness, timeliness or applicability of Model responses to the User’s tasks. Model responses may contain errors, inaccuracies, factual distortions (so-called “hallucinations”). The User must critically evaluate received information and verify it before making any decisions;
- uninterrupted or continuous availability of the Service. Access may be temporarily restricted due to maintenance, infrastructure incidents, actions of Model Providers, changes in law, or force majeure;
- fitness of the Service for the User’s particular purpose;
- compliance of the Service with the laws of the User’s country.
The Operator is not liable for:
- decisions made by the User or third parties based on Model responses (medical, legal, financial, engineering, psychological, educational and other);
- harm caused by the User or third parties as a result of using content received from Models;
- the content submitted by the User to the Service and the User’s compliance with the rights of third parties;
- the operation of the Models themselves, their quality, security or availability — these matters are the responsibility of the Model Providers;
- the User’s indirect losses, including lost profits, business reputation damage, data loss or downtime;
- suspension or termination of individual Models by their Providers;
- actions of payment providers, card issuers, telecom operators and other third parties.
The Operator’s aggregate liability for any claims arising out of or in connection with the use of the Service is limited to the amount actually deducted from the User’s Balance during the 3 (three) calendar months preceding the event giving rise to the claim.
The limitations of this section do not apply to cases of wilful harm or gross negligence by the Operator (Article 359 of the Civil Code of the Republic of Kazakhstan), or where mandatory applicable law does not permit such limitations.
12.Intellectual property
- rights to the Service and its elements (source code, design, texts, logos) belong to the Operator;
- rights to the Models and their software belong to the respective Model Providers;
- rights to content submitted by the User to the Service belong to the User or other rightsholders to whom the User is solely liable;
- the ownership of rights to content generated by Models in response to User Requests is governed by the terms of the respective Model Provider and applicable law. The Operator claims no such rights and makes no warranty as to their ownership by the User.
13.Termination
- the User may at any time stop using the Service and delete the Account through the Service interface or by sending a request to the Operator;
- upon Account deletion, the unused Balance is refunded under the “Refunds” section only upon the User’s written request to the Operator’s email address;
- the Operator may unilaterally suspend or terminate the provision of services to the User in the event of a breach of this offer, applicable law, discontinuation of Model Providers, or for technical or economic reasons;
- where the Operator terminates the agreement due to the User’s breach of this offer, funds are not refunded.
14.Changes to the terms
The Operator may unilaterally amend this offer. The current version and its effective date are published at /terms. Material changes are additionally notified to the email address provided by the User upon registration.
Continued use of the Service after publication of changes constitutes the User’s acceptance of the new version. If the User does not agree with the changes, they may stop using the Service and request a refund of the unused Balance in accordance with the “Refunds” section.
15.Governing law and dispute resolution
The relations of the Parties under this offer are governed by the laws of the Republic of Kazakhstan. All disputes shall be settled through negotiations. If agreement cannot be reached, the dispute shall be submitted to the court at the Operator’s location (Almaty, Republic of Kazakhstan) or to another competent court in accordance with applicable procedural law.
If any provision of this offer is held invalid, this does not invalidate the offer as a whole — such provision applies to the extent permissible or is replaced by the applicable rule of law.
