1. Definitions
- Operator — the person identified in the preamble and the Operator details section;
- Service — the software and hardware system available at cheapai.io, including the web interface, API and user console;
- Gateway — the Service interface that proxies User Requests to Models;
- Model — an AI neural network model provided by a third-party Provider (Anthropic, OpenAI, Google and others);
- Model Provider — a third party that owns or otherwise holds rights to a Model;
- User — a person who has registered with the Service and accepted this offer;
- Account — the User's record in the Service;
- Plan — a set of access conditions to the Service (list of available Models, usage limits, price, payment cadence) published on the relevant page of the Service;
- Subscription — the User's active link to the chosen Plan with its current period;
- Request — the User's invocation of a Model through the Gateway;
- API key — a secret token issued to the User for programmatic access to the Gateway.
2. Subject of the contract
The Operator provides the User with the technical ability to send Requests to third-party Models through a single OpenAI-compatible API and the Service's web interface on a prepaid basis.
The Operator is not the developer, owner or rightholder of the Models. The Operator provides solely intermediary technical services — acceptance of a Request, forwarding it to the relevant Model Provider and passing the response back to the User.
3. Registration and account
- registration is available to persons who have reached the age of 18 and possess the legal capacity required;
- the User undertakes to provide accurate information at registration and to keep it up to date;
- the User is responsible for keeping the password and API keys safe; all actions performed using the User's credentials are deemed to be performed by the User;
- the User is responsible for compliance with the legislation applicable to them, including restrictions on the use of AI services in their country.
4. Plans and payment
- the Service is provided on a subscription basis — the User selects one of the Plans listed on the relevant page of the Service together with their current pricing;
- upon registration the User is automatically granted the free (Free) Plan with minimal limits; switching to a paid Plan is performed by the User through the personal account;
- paid Plans are billed in advance via a payment provider for the subscription period (by default — one calendar month); funds are charged automatically on the renewal date unless the subscription has been cancelled before that moment;
- within the selected Plan the Operator grants access to a defined set of Models and applies usage limits in the form of rolling time windows (for example, 5-hour and weekly), measured in tokens;
- the Operator may change the set of Plans, limits, available Models and their pricing. Changes apply to new subscriptions and to the next paid period of existing subscriptions from the date of publication;
- for material changes (price increase, lower limits, removal of Models) the Operator notifies active subscribers by email at least 14 (fourteen) calendar days before the changes take effect. The User may cancel the subscription before that moment without any consequences.
5. Cancellation and refunds
- the User may cancel the subscription at any time through the personal account; on cancellation the access to the Service is preserved until the end of the paid period, after which the subscription automatically moves to the "canceled" status and automatic renewal stops;
- the cost of the paid but fully or partially unused period is non-refundable — the Operator's services under this offer are considered duly rendered from the moment the subscription is activated until the end of the paid period (Art. 393 of the Civil Code of the Republic of Kazakhstan);
- for a confirmed fraudulent transaction (payment made without the consent of the payment instrument owner) funds are refunded after an internal investigation; to initiate a request the User contacts the Operator's email with supporting documents;
- no refund is made if the Account has been blocked by the Operator for a breach of this offer.
6. Prohibited use
The User is prohibited from using the Service for:
- breaching the legislation of the Republic of Kazakhstan, the User's country, or applicable international law;
- creating, distributing or storing child sexual abuse material; incitement of terrorism, extremism, or hatred on national, racial or religious grounds;
- creating, distributing or modifying malicious software;
- infringing intellectual or other rights of third parties;
- processing personal data of third parties without a proper legal basis;
- producing falsified images, audio or video of real people without their consent (so-called deepfake material), particularly for defamation, fraud or other harm;
- mass automated requests aimed at disrupting the Service (DDoS, credential stuffing, etc.);
- attempts to gain unauthorised access to the Service's infrastructure, bypass restrictions or limits;
- reverse engineering the Service or its components;
- sending spam, phishing or fraudulent messages;
- transferring the Account or API keys to third parties (save where the User uses the Service on behalf of and in the interests of the legal entity the User is associated with);
- violating the Acceptable Use or Usage Policies of Model Providers.
Breach of the prohibitions is grounds for immediate suspension of the Account without refund of unused or charged funds. Where required by law the Operator will report relevant information to the authorised state bodies.
7. User warranties
By accepting this offer the User confirms that they:
- have reached the age of 18 and have the legal capacity required to enter into this contract;
- hold all rights necessary to submit to the Service the content they submit (text, files, images) and have it processed by the Models;
- have read the Service's Privacy Policy and consent to the processing of their personal data on its terms;
- understand that the Service provides intermediary access to third-party Models and accept the associated risks;
- use the Service at their own risk and bear sole responsibility for any use of the outputs received from the Models.
8. Limitation of liability
The Service is provided "AS IS" and "AS AVAILABLE".
The Operator gives no express or implied warranty in respect of the Service, including but not limited to:
- accuracy, completeness, correctness, timeliness or fitness of the Models' outputs for the User's tasks. Outputs may contain errors, inaccuracies and so-called "hallucinations". The User must critically evaluate the information and verify it before making any decisions;
- uninterrupted or continuous operation. Access to the Service may be temporarily restricted due to maintenance, infrastructure incidents, actions of Model Providers, changes in legislation, or force majeure;
- fitness of the Service for a particular User task;
- compliance of the Service with the legislation of the User's country.
The Operator is not liable for:
- decisions made by the User or third parties based on Model outputs, including medical, legal, financial, engineering, psychological or educational;
- harm caused by the User or third parties as a result of using content received from the Models;
- the content the User submits to the Service and the User's compliance with third-party rights;
- the operation of the Models themselves, their quality, safety or availability — these are matters for the Model Providers;
- the User's indirect losses, including lost profit, reputational harm, data loss or downtime;
- suspension or discontinuation of individual Models at the initiative of their Providers;
- actions of payment providers, card-issuing banks, telecom operators and other third parties.
The Operator's aggregate liability for any claims related to use of the Service is limited to the amount of funds paid by the User for the Subscription over the 3 (three) calendar months preceding the event giving rise to the claim.
The limitations of this section do not apply to cases of intentional harm or gross negligence on the part of the Operator (Article 359 of the KZ Civil Code), nor to cases where applicable mandatory law does not permit such limitations.
9. Intellectual property
- rights in the Service and its elements (source code, design, texts, logos) belong to the Operator;
- rights in the Models and their software belong to the respective Providers;
- rights in the content submitted to the Service by the User belong to the User or other rightholders, with respect to whom the User bears sole responsibility;
- ownership of rights in content generated by Models in response to the User's Requests is governed by the terms of use of the relevant Model Provider and by applicable law. The Operator does not claim such rights and gives no warranty that they belong to the User.
10. Termination
- the User may cancel the Subscription at any time through the personal account, and delete their Account through the Service interface or by request to the Operator;
- on cancellation by the User the Cancellation and Refunds section applies — access is preserved until the end of the paid period, and the cost of the unused portion is non-refundable;
- the Operator may unilaterally suspend or terminate service to the User in the event of a breach of this offer, of applicable law, discontinuation of Model Providers, or for technical or economic reasons;
- on termination by the Operator for a User breach of this offer, funds are not refunded.
11. Changes to these terms
The Operator may unilaterally amend this offer. The current version and its effective date are published on the /terms/ page. Material changes are also notified to the email address the User provided at registration.
Continued use of the Service after publication of changes means the User's agreement to the new version. If the User does not agree, they may cancel the Subscription through the personal account before the changes take effect (see the Plans and payment section).
12. Governing law and dispute resolution
The legislation of the Republic of Kazakhstan applies to the relations of the parties under this offer. All disputes shall first be settled through negotiations. Failing agreement, disputes are subject to a court at the Operator's location (Republic of Kazakhstan, Almaty) or another competent court in accordance with applicable procedural law.
If any provision of this offer is held to be invalid, this does not entail invalidity of the offer as a whole — the relevant provision applies to the extent permitted or is replaced by the applicable rule of law.
